Objective

SinSysCo's objective is to develop products and tools that facilitate enhanced safety and foster more comprehensive awareness of the well-being of those in one's care. The following Terms of Service (henceforth referred to as the "Terms") shall henceforth apply to any and all access and use of the SinSysCo Service. The term "SinSysCo Service" encompasses our devices, in addition to the associated firmware, applications, software, websites, APIs, products, and services.

In the event that the user resides within the European Economic Area, the United Kingdom, or Switzerland, the aforementioned Terms constitute an agreement between the user and SinSysCo Pty Limited. In the event that the aforementioned terms make reference to "SinSysCo," "we," "us," or "our," such references are to be understood as denoting the party with whom you have entered into an agreement for the provision of the SinSysCo Service.

In order to create a SinSysCo account and gain access to or utilize the SinSysCo Service, it is necessary to accept these Terms. In the event that an account has not yet been established, acceptance of these Terms is implied through the use of any component of the SinSysCo Service. Should one decline to accept these Terms, it is not permissible to create an account or employ the SinSysCo Service.

1. Read Our Privacy Policy

For details regarding our data practices, please refer to our Privacy Policy, including our Cookies Statement. By accessing or using the SinSysCo Service, you consent to the collection and use of your information in accordance with the Privacy Policy.

2. Use of the SinSysCo Service

It should be noted that only the following methods of connection are permitted to the SinSysCo Service:

  • A device manufactured, distributed, or sold by SinSysCo itself or through its authorized resellers or agents;
  • Our mobile applications and software, or approved third-party applications, software, or devices; or
  • Our websites ("Authorized Connections").

It is not permissible to establish a connection to the SinSysCo Service with any device that is not manufactured, distributed, or sold by SinSysCo itself or through its authorized resellers or agents. This encompasses any device that is a counterfeit or knock-off version of a SinSysCo device, or any unauthorized application or third-party connection.

Any violation or attempted violation of this provision may result in the immediate termination of one's ability to access the SinSysCo Service. Should any questions arise regarding the qualification of a product or application as an Authorized Connection, one is encouraged to contact Customer Support.

3. Use of an Account

Please be advised that in order to utilize the SinSysCo Service in its entirety, it is necessary to establish an account. In the event that a SinSysCo account is required, or if the user elects to utilize the SinSysCo Service in conjunction with an existing SinSysCo account, these Terms shall be terminated automatically and without further notice in accordance with Section 19 below.

It is the responsibility of the account holder to ensure the security of their account and to take all necessary precautions to prevent any unauthorized access or use. SinSysCo cannot be held liable for any loss or damage resulting from the account holder's failure to maintain the confidentiality of their account credentials. In the event of any suspected security breach related to the SinSysCo Service or the account, the account holder is required to notify Customer Support immediately.

4. Necessary Equipment

It should be noted that the full functionality of the SinSysCo Service is contingent upon the utilization of a computer with the requisite software or a compatible mobile device, coupled with an active internet connection. The maintenance and security of the aforementioned equipment may impact the performance of the SinSysCo Service, and it is the responsibility of the user to ensure the optimal functionality of the equipment. The user is also responsible for all internet access charges. It is recommended that the user consult with their internet service provider for information regarding any potential data usage charges.

5. Posting Your Content on the SinSysCo Service

SinSysCo may facilitate the posting, uploading, storage, sharing, sending, or displaying of a diverse array of content, including photographs, images, video, data, text, music, exercise regimens, food logs, recipes, comments, and other forms of information and content ("Your Content"). This content may be disseminated via the SinSysCo Service. The user shall retain all rights to the content that is posted to the SinSysCo Service. By making Your Content available on or through the SinSysCo Service, you hereby grant to SinSysCo a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, publicly display, publicly perform, reproduce, translate, create derivative works from, and distribute Your Content, in whole or in part, including your name and likeness, in any media. The rights granted in this Section 5 are limited to the purpose of offering and improving the SinSysCo Service.

It is the responsibility of the user to ensure that the content in question is appropriate and in compliance with the aforementioned terms. You certify that you are the proprietor of the content in question or that you have obtained all requisite permissions to grant us the aforementioned license.

It is your responsibility to ensure that your content, the use and provision of your content on the SinSysCo Service, and your use of the SinSysCo Service do not:

  • infringe, misappropriate, or violate a third party´s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy;
  • violate, or encourage any conduct that would violate, any applicable law or regulation or would give rise to civil liability;
  • be fraudulent, false, misleading, or deceptive;
  • be defamatory, obscene, pornographic, vulgar, or offensive;
  • promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
  • be violent or threatening or promote violence or actions that are threatening to any person or entity;
  • be used to promote illegal or harmful activities or substances.

Moreover, it is agreed that the following actions shall be prohibited:

  • Uploading any content that contains software viruses or is designed to interrupt, destroy, or limit the functionality of any equipment or services, or that contains other harmful, disruptive, or destructive files or content;
  • Utilizing or endeavoring to utilize another user's account without authorization, or impersonating any person or entity;
  • Harvesting, soliciting, or collecting information from other users for any reason whatsoever, including, without limitation, for the purpose of sending unsolicited communications;
  • Posting, advertising, or promoting products or services commercially, or uploading any content that is advertising, promotional material, junk mail, spam, or a contest or sweepstake, or that furthers or promotes criminal activity;
  • Utilizing the SinSysCo Service in any manner that, at our discretion, is deemed objectionable or restricts or inhibits any other individual from utilizing or enjoying the SinSysCo Service, or which may expose us or our users to any harm or liability of any type.

SinSysCo reserves the right to alter, remove, or refuse to display any content uploaded by users, and may prohibit the posting, uploading, storing, sharing, sending, or displaying of such content via the SinSysCo Service.

6. SinSysCo`s Rights

The term "SinSysCo Content" encompasses any and all materials that are uploaded, generated, provided, or otherwise made available through the SinSysCo Service, including but not limited to photographs, images, graphics, videos, audio files, data, text, music, exercise regimens, food logs, recipes, comments, software, and any other form of intellectual property. The SinSysCo Content, the SinSysCo Service, and its underlying technology are protected by copyright, trademark, patent, intellectual property, and other laws of the country of use. Any rights not expressly set forth in these Terms are reserved. It is agreed that no element of the copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the SinSysCo Service shall be removed, changed, or obscured. The logos and any other trademarks of SinSysCo that may be displayed on the SinSysCo Service, in addition to the overall visual identity of the SinSysCo Service, including page headers, graphics, icons, and scripts, may not be reproduced, imitated, or used, in whole or in part, without the prior written permission of SinSysCo. Additionally, any other trademarks, product or service names, company names, or logos mentioned on the SinSysCo Service are the intellectual property of their respective owners. As such, they may not be copied, imitated, or used, in whole or in part, without the express permission of the applicable trademark holder.

7. What You Can Do on the SinSysCo Service

Thhe SinSysCo Service is intended for use by individuals for non-commercial purposes.

SinSysCo hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Access and utilize the SinSysCo Service,
  • Access and view the SinSysCo Content,
  • Access and utilize the software and mobile applications provided by the SinSysCo Service, and
  • Use the software embedded into SinSysCo devices in accordance with the terms set forth herein.

In regard to items (3) and (4), this license encompasses any third-party software embedded in any SinSysCo Service. This license is provided exclusively for your personal, noncommercial use and enjoyment of the SinSysCo Service in accordance with the stipulations set forth in these Terms.

It is not permitted to use, sublicense, copy, adapt, modify, translate, disclose, prepare derivative works based upon, distribute, license, sell, rent, lease, assign, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit the SinSysCo Content, SinSysCo Service, or any portion thereof (including any third-party software), except as expressly permitted in these Terms. No licenses or rights are granted to the user by implication or otherwise under any intellectual property rights owned or controlled by SinSysCo or its licensors, except for the licenses and rights expressly granted in these Terms.

It is not permitted, except to the extent permitted by law, to perform, attempt to perform, or encourage or assist others in performing any of the following while accessing or using the SinSysCo Service:

  • Use, display, mirror, or frame the SinSysCo Service or any individual element within the SinSysCo Service, including the layout and design of any page, without SinSysCo`s express written consent;
  • Use SinSysCo`s name, any SinSysCo trademark or logo, or any SinSysCo proprietary information without SinSysCo`s express written consent;
  • Access or tamper with non-public areas of the SinSysCo Service, SinSysCo`s computer systems, or the technical delivery systems of SinSysCo`s providers. Furthermore, it is prohibited to test the vulnerability of any SinSysCo system or breach any security or authentication measures. Additionally, it is prohibited to circumvent any technological measure implemented by SinSysCo or any of SinSysCo`s providers or any other third party (including another user) to protect the SinSysCo Service;
  • Accessing the SinSysCo Service or SinSysCo Content through any mechanism other than an authorized connection, SinSysCo service, or SinSysCo API; or
  • Modifying, decompiling, disassembling, reverse engineering, tampering with, or otherwise attempting to derive the source code of any software provided by SinSysCo.

8. Hyperlinks

A limited, non-exclusive, and non-transferable right is hereby granted to create a text hyperlink to the SinSysCo Service for non-commercial purposes. However, such a link may not portray the grantee or any of the grantee's products or services in a false, misleading, derogatory, or otherwise defamatory manner. Furthermore, the linking site may not contain any material that is adult or illegal in nature, or any material that is offensive, harassing, or otherwise objectionable. Such limited rights may be revoked at any time at the discretion of SinSysCo.

9. Our Enforcement Rights

We reserve the right to remove or disable access to the SinSysCo Service, any SinSysCo Content, or Your Content at any time and without notice, and at our sole discretion, if we determine that the SinSysCo Content, Your Content, or your use of the SinSysCo Service is objectionable or in violation of these Terms. Furthermore, we reserve the right to investigate any potential violations of these Terms of Service, as well as any conduct that may affect the SinSysCo Service. In the event of such an investigation, we reserve the right to take any action we may deem appropriate in response.

10. Use the SinSysCo Service at Your Own Risk

Any reliance on SinSysCo Content or the SinSysCo Service is undertaken at the user's own risk. The objective of this endeavor is to furnish the public with beneficial and precise information regarding the SinSysCo Service. However, it should be noted that no endorsement, representation, or warranty of any kind is made with regard to any SinSysCo Content, information, or services. It should be noted that the accuracy of the data collected and presented through the SinSysCo Service is not intended to match that of medical or scientific measurement devices.

It should be noted that we do not assume responsibility for the accuracy, reliability, availability, effectiveness, or correct use of information received through the SinSysCo Service. It should be noted that the SinSysCo Content and the SinSysCo Service may change from time to time or vary by geographic location. Consequently, it is possible that maps, directions, and other GPS or navigation data, including data relating to your current location, may be unavailable, inaccurate, or incomplete.

11. Consult Your Doctor Before Using the SinSysCo Service

It should be noted that the SinSysCo Service is not intended to diagnose, treat, cure, or prevent any disease. Individuals with pre-existing medical or cardiovascular conditions are advised to seek the guidance of a qualified medical professional before engaging with the SinSysCo Service, undertaking an exercise program, or making dietary changes. In the event of a medical emergency, it is imperative to cease all use of the SinSysCo Service and seek immediate medical attention. The SinSysCo Service does not assume any liability for any adverse health effects that may arise from training programs, consultations, products, or events that are accessed through the SinSysCo Service. In engaging with any exercise program received or learned about through the SinSysCo Service, users acknowledge that they do so at their own risk and are voluntarily participating in these activities.

It has been observed that prolonged contact with wearable devices may contribute to the development of skin irritation or allergic reactions in some individuals. To mitigate the potential for irritation, it is recommended to adhere to four fundamental principles pertaining to wear and care:

  • It is recommended that the device be kept clean,
  • that it be kept dry,
  • that it not be worn too tightly, and
  • that the wrist be allowed to rest by removing the band for an hour after extended wear. Further information can be found on the company website.

In the event of any dermatological irritation, discomfort, numbness, burning, or stiffness in the hands or wrists, it is recommended to immediately cease use of the product and remove it from the affected area. In the event that symptoms persist for a period exceeding two to three days following the removal of the device, it is recommended that a medical professional be consulted.

It should be noted that products utilizing PurePulse technology, such as those manufactured by SinSysCo, may pose certain risks to users with specific health conditions. It is recommended that individuals with specific health conditions, including those with a history of epilepsy or sensitivity to flashing lights, as well as those with reduced circulation or a tendency to bruise easily, should consult with a medical professional prior to using such products. This is also advised for those who are taking photosensitive medication or have a medical or heart condition. Additionally, individuals with tendonitis, carpal tunnel syndrome, or other musculoskeletal disorders should exercise caution and seek guidance from a healthcare professional.

12. DMCA/Copyright Policy

SinSysCo holds the intellectual property of others in high regard and similarly expects its users to respect the intellectual property rights of others. In appropriate circumstances and at the discretion of SinSysCo, the accounts of users who repeatedly infringe the rights of copyright holders may be disabled or terminated.

13. Feedback and Submissions Policy

Should you submit comments, ideas, or feedback to us, you thereby consent to our unrestricted use, disclosure, reproduction, distribution, and exploitation of said submissions without any obligation to provide compensation. Furthermore, we reserve the right to use similar or related ideas or feedback previously known to us, developed by SinSysCo, or obtained from sources other than you. Our Feedback and Submissions Policy is also incorporated into the Terms.

14. Contests and Giveaways

It should be noted that additional terms and conditions may apply to surveys, contests, giveaways, and other promotions sponsored by SinSysCo or its partners. It is the responsibility of the individual to carefully review those terms and conditions.

15. Alerts and Notifications

As a consequence of utilizing the SinSysCo Service, you may be in receipt of notifications, text messages, alerts, emails, and other forms of electronic communication. By accepting these terms and conditions, you consent to receive the aforementioned communications. The majority of these communications can be controlled by adjusting the settings associated with your SinSysCo account. In certain instances, we may be required to provide you with specific communications, such as service announcements and administrative messages. It is your responsibility to cover any fees charged by your wireless carrier for messaging or data usage. Any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including the stipulation that the communication be in writing.

16. Third-Party Services

It should be noted that the SinSysCo Service may display or permit linking or other access to or use of third-party content, promotions, websites, apps, services, and resources (collectively, "Third-Party Services") that are not under SinSysCo`s direct control. Such an opportunity may arise whereby the user is able to link their SinSysCo account, SinSysCo data, or the SinSysCo Service with Third-Party Services. The provision of these links is intended to be a convenience only, and SinSysCo disclaims any responsibility for the products, services, or other content that may be available from third-party services. It is acknowledged that any third-party services utilized in conjunction with the SinSysCo Service, including third-party applications accessed on SinSysCo devices, are not part of the SinSysCo Service and are not under the control of SinSysCo. Consequently, responsibility for and risk associated with interactions with or utilization of any third-party services lie solely with the user. Furthermore, it is acknowledged that the aforementioned Terms and the SinSysCo Privacy Policy do not apply to any Third-Party Services. It is the responsibility of the user to familiarize themselves with the terms and conditions, as well as the privacy policy, that pertain to their utilization of any Third-Party Services.

17. Changes to the SinSysCo Service

It should be noted that SinSysCo reserves the right to modify or discontinue, temporarily or permanently, any feature, component, or content of the SinSysCo Service at any time without prior notification. SinSysCo is not liable to users or third parties for any modification, suspension, or discontinuation of any feature, component, or content of the SinSysCo Service. The company reserves the right to determine the timing and content of software updates, which may be automatically downloaded and installed by SinSysCo products without prior notice to users.

18. Termination

We reserve the right to suspend or deactivate your account or your access to certain aspects or all of the SinSysCo Service, or to terminate these Terms, at our sole discretion, at any time and without notice or liability to you. In the event of suspension, deactivation, or termination, we reserve the right to delete or remove any content or other information related to the account in question. Should you wish to terminate your account, you may do so by contacting Customer Support. In the event that these Terms are terminated, suspended, terminated, or the SinSysCo Service or your account is discontinued, the following provisions of these Terms will remain in effect: Sections 1, 5, 6, 9, 10, 11, 13, 14, 15, 16, and 17.

19. Disclaimers

THE SINSYSCO SERVICE AND SINSYSCO CONTENT ARE PROVIDED "AS IS," WITHOUT ANY WARRANTY WHATSOEVER. FURTHERMORE, WE EXPLICITLY DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SINSYSCO SERVICE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. FURTHERMORE, NO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT ARE PROVIDED, AND NO WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE ARE GIVEN.

It should be noted that no guarantee is offered that the SinSysCo Service or SinSysCo Content will meet the specific requirements of the user or be available on an uninterrupted, secure, or error-free basis. Similarly, no warranty is provided regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of the SinSysCo Service or any SinSysCo Content.

20. Indemnity

You shall indemnify and hold harmless SinSysCo or its officers, directors, employees, affiliates, agents, licensors, and contractors from and against any and all claims, suits, actions, demands, disputes, allegations, or investigations brought by any third party, governmental authority, or industry body, and all liabilities, damages, losses, costs, and expenses, including without limitation reasonable attorneys’ fees. Such indemnification shall extend to any and all claims, suits, actions, demands, disputes, allegations, or investigations that may arise out of or in any way be connected with:

  • the access of the SinSysCo Service by the indemnifying party,
  • the use of the SinSysCo Service by the indemnifying party,
  • the breach or alleged breach of any warranties made by the indemnifying party hereunder or the violation of any other provision of these Terms by the indemnifying party, or
  • the violation of any law or the rights of a third party by the indemnifying party.

We reserve the right to assume control of the defense of any third-party claim that is subject to indemnification by you. In such an event, you will cooperate with us in asserting any available defenses.

21. Limitation of Liability

IT IS EXPLICITLY STATED THAT NEITHER SINSYSCO, ITS SUPPLIERS, NOR LICENSEES, NOR ANY OTHER PARTY INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE SINSYSCO SERVICE WILL BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SINSYSCO SERVICE. IN ADDITION, NO LIABILITY IS ACCEPTED FOR ANY INDIRECT OR CONSEQUENTIAL LOSS, INCLUDING LOSS OF DATA OR GOODWILL, INTERRUPTION TO THE SERVICE, COMPUTER DAMAGE, SYSTEM FAILURE OR THE COST OF SUBSTITUTE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SINSYSCO HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH LOSS. THIS EXCLUSION OF LIABILITY EXTENDS TO ANY AND ALL LEGAL THEORIES, INCLUDING NEGLIGENCE, PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SINSYSCO HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. THIS EXCLUSION OF LIABILITY ALSO EXTENDS TO INSTANCES WHERE A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL SINSYSCOo`S TOTAL LIABILITY FOR ANY CAUSE WHATSOEVER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SINSYSCO SERVICE, EXCEED THE AMOUNT SPECIFIED HEREIN. IN THE EVENT THAT THE USER HAS MADE A PAYMENT TO SINSYSCO FOR THE USE OF THE SINSYSCO SERVICE, OR AN AMOUNT EQUAL TO ONE HUNDRED DOLLARS ($100), IN THE EVENT THAT NO PAYMENT OBLIGATIONS TO SINSYSCO HAVE BEEN INCURRED, THE AFOREMENTIONED TERMS SHALL APPLY.

THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE REPRESENT FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN SINSYCO AND THE USER. IT SHOULD BE NOTED THAT SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND THUS THE AFOREMENTIONED LIMITATION MAY NOT APPLY IN SUCH JURISDICTIONS.

22. Dispute Resolution

IT IS IMPERATIVE THAT YOU CAREFULLY REVIEW THE FOLLOWING SECTION, AS IT OUTLINES THE CIRCUMSTANCES UNDER WHICH YOU ARE REQUIRED TO SUBMIT DISPUTES AND CLAIMS TO ARBITRATION WITH US AND THE MANNER IN WHICH YOU MAY SEEK REDRESS FROM US.

It is agreed that any dispute between the parties hereto and SinSysCo arising out of or relating to these Terms of Service, the SinSysCo Service, or any other SinSysCo products or services (collectively, “Disputes”) shall be governed by the arbitration procedure outlined below.

Informal Dispute Resolution: It is our intention to address your concerns in a manner that does not necessitate the initiation of a formal legal proceeding. Prior to initiating legal proceedings against SinSysCo, you consent to first attempting to resolve the dispute through informal means. To this end, you shall contact us at the mailing address provided in the Contact Us section of the Terms below, furnishing us with your email address. We shall then endeavor to resolve the dispute through informal means by contacting you via email. In the event that the dispute remains unresolved for a period of fifteen days following submission, you or SinSysCo may pursue a formal proceeding.

It is hereby agreed by the parties that any and all disputes shall be resolved through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below. Should any party wish to decline this agreement to arbitrate, they may do so by contacting info@SinSysCo.com within 30 days of first accepting these Terms of Service and stating that they (include their first and last name) decline this arbitration agreement.

It should be noted that the possibility of initiating class actions is not permitted. It is not permitted to resolve disputes with SinSysCo on a collective basis; rather, each dispute must be addressed on an individual basis. Furthermore, it is not permissible to initiate legal proceedings as either a plaintiff or a class member in a class, consolidated, or representative action. The aforementioned agreement explicitly prohibits the use of class arbitrations, class actions, private attorney general actions, and the consolidation of arbitrations with other proceedings.

Forum for the Resolution of Disputes: In the event that the agreement to arbitrate is found not to apply to the individual or their claim, the parties agree that any judicial proceeding (other than small claims actions) will be brought in the federal or state courts of San Francisco County, California, unless otherwise required by applicable law. Both the plaintiff and the defendant consent to the venue and personal jurisdiction of the aforementioned court. It is agreed that neither party shall be entitled to a jury trial. With regard to the limitation of claims, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of SinSysCo products or services must be filed within one (1) year after such claim or cause of action arose. Otherwise, that claim or cause of action shall be forever barred.

23. General Terms

Unless otherwise stated herein, these Terms represent the entire and exclusive understanding and agreement between SinSysCo and the user regarding the SinSysCo Service. These Terms supersede and replace any and all prior oral or written understandings or agreements between SinSysCo and the user regarding the SinSysCo Service and SinSysCo Content.

Should any material changes be made to these Terms, we will notify you and provide an opportunity for you to review the revised Terms before continuing to use the SinSysCo Service. Upon utilizing the SinSysCo Service subsequent to the implementation of a modification, you are indicating your acceptance of the revised Terms. Previous iterations of these Terms can be accessed in our archive for your reference.

In the event that a court of competent jurisdiction determines the invalidity or unenforceability of any provision of these Terms, that particular provision shall be enforced to the fullest extent permitted by law, while the remaining provisions of these Terms shall remain in full force and effect.

It is not permitted to assign, delegate, or transfer these Terms, whether by operation of law or otherwise, without the prior written consent of SinSysCo. Any attempted assignment or transfer of these Terms without the requisite consent shall be deemed null and void. Furthermore, SinSysCo is at liberty to assign or transfer these Terms without restriction. In accordance with the aforementioned stipulations, these Terms shall be binding upon and shall benefit the aforementioned parties, their successors, and any permitted assignees.

Any notices or other communications provided by SinSysCo under these Terms, including those regarding modifications to these Terms, shall be given in the following manner: Notices shall be provided via email or by posting to the SinSysCo Service. In the event that notices are transmitted via email, the date of receipt will be deemed to be the date on which the notice is transmitted.

SinSysCoo`s failure to enforce any right or provision of these Terms will not be construed as a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SinSysCo. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
